Memollo lets you create and share personalized digital surprise gifts with messages, photos, music, animations, and a unique shareable link or QR code.
You are responsible for the photos, messages, and other content you add to your Gift and for making sure you have the right to use them.
Your Gift is accessed through a unique link. Anyone who obtains that link may be able to view the Gift, so only share it with people you trust.
Memollo is intended for adults. You must be at least 18 years old or the age of majority where you live to make a purchase or use the Service independently.
By using Memollo, you agree to these Terms and our Privacy Policy.
1. Acceptance and Definitions
By accessing or using memollo.com (“Memollo,” “we,” “us,” “our,” or the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy.
If you do not agree to these Terms, please do not use the Service.
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is applicable, to make a purchase or use the Service independently.
For these Terms:
“Gift” means a personalized digital surprise created through Memollo.
“Content” means names, messages, text, photos, images, and other information or materials you submit or upload.
“User” means anyone who visits, creates, purchases, shares, accesses, or otherwise uses the Service.
2. What Memollo Provides
Memollo allows users to create and share personalized digital Gifts for birthdays, romantic moments, anniversaries, celebrations, and other occasions.
Depending on the features available at the time, Gifts may include:
- Personalized names and messages
- Uploaded photos
- Music selections
- Animations and visual effects
- Visual customization
- Unique shareable links
- QR codes
- Access-protection features where available
Features, designs, prices, and customization options may change as Memollo develops.
3. Creating, Accessing and Sharing Gifts
You are responsible for the Content you provide when creating a Gift, including names, messages, photos, and other personal information.
Gifts are accessed through unique shareable links.
Anyone who obtains a Gift link may be able to view the Gift and its Content. You should only share your Gift link with people you trust.
If another person copies, forwards, publicly posts, or otherwise shares your Gift link, Memollo cannot guarantee that access will remain limited to your intended recipient.
If Memollo offers passcode or other access protection and you enable it, you are responsible for keeping that information secure.
If Memollo provides you with a private editing link or other editing credential, you are responsible for keeping it confidential. Anyone who obtains such access may potentially be able to modify the associated Gift.
4. Your Content and Permissions
You retain ownership of your Content.
Memollo does not become the owner of the photos, messages, or other Content you upload.
By submitting Content to Memollo, you grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce, and display that Content only as reasonably necessary to operate the Service, provide your Gift, and comply with applicable legal obligations.
You represent that you own your Content or have the necessary rights and permissions to use and share it.
This includes obtaining appropriate permission to use photographs of other people, copyrighted materials, or other third-party Content where required.
You are responsible for the Content you upload and share through Memollo.
5. Privacy and Data
Our Privacy Policy explains how we collect, use, process, store, and protect personal information.
Memollo may use third-party providers to operate the Service, including providers for:
- Payment processing
- Website hosting
- Database and file storage
- Analytics
- Website performance and security
Cookies and similar technologies may also be used as described in our Privacy Policy and Cookie Policy.
By using Memollo, you acknowledge that information may be processed in countries other than the country where you live, subject to applicable privacy laws and safeguards.
6. Payments and Refunds
Some Memollo features require payment.
Prices are displayed before checkout and may vary depending on the product, currency, region, promotion, or features selected.
Payments are processed through Stripe or another payment provider that we may make available.
Memollo does not directly store your complete credit or debit card details.
By completing a purchase, you confirm that:
- You are authorized to use the selected payment method
- The payment information you provide is valid
- You authorize the applicable charge
- You agree to pay the displayed price and any applicable taxes
Refund Policy
Because Memollo provides personalized digital products, purchases are generally final and non-refundable once a Gift has been created, delivered, accessed, or otherwise made available.
We generally do not provide refunds because:
- You change your mind after purchasing
- You no longer want to send the Gift
- You entered incorrect information
- You uploaded an incorrect photo
- The recipient does not open the Gift
- The recipient does not respond or react as expected
- You or the recipient shared the Gift link with another person
- Minor visual differences occur between devices, browsers, or screen sizes
If you experience a duplicate charge, incorrect charge, or verified technical problem caused by Memollo that prevents you from accessing your purchased Gift, contact us at hello@memollo.com.
We will review the issue and provide an appropriate remedy where required.
Nothing in this Refund Policy limits refund, cancellation, or other consumer rights that cannot legally be excluded under applicable law.
7. Gift Hosting and Availability
Unless otherwise stated at the time of purchase, a purchased Memollo Gift includes one year of hosting.
The applicable hosting period begins according to the terms presented at the time of purchase.
After the hosting period expires, the Gift may no longer be available unless an extension or renewal option is offered.
We may offer additional hosting or renewal options in the future, but we are not required to do so.
You should keep your own copies of original photos and other important Content.
Memollo should not be used as your only permanent storage location for photos or important files.
8. Acceptable Use and Prohibited Content
You agree not to use Memollo for illegal, fraudulent, deceptive, threatening, abusive, harassing, discriminatory, or otherwise unlawful purposes.
You must not upload, create, or share Content that:
- Violates applicable law
- Violates another person’s privacy or legal rights
- Infringes copyright, trademark, or other intellectual property rights
- Contains personal or sensitive information that you do not have the right to share
- Is defamatory, threatening, abusive, or harassing
- Exploits or endangers children
- Contains unlawful sexually explicit material
- Contains malware, malicious code, spam, or fraudulent material
- Impersonates another person for deceptive or harmful purposes
- Is intended to scam, deceive, exploit, or harm another person
You also agree not to interfere with the operation or security of Memollo, attempt unauthorized access to our systems, or use automated systems to excessively scrape or abuse the Service.
9. Moderation, Removal and Suspension
Memollo does not routinely review every private Gift before it is created or shared.
However, we reserve the right to remove, disable, restrict, or suspend access to Content or Gifts if we reasonably believe that:
- These Terms have been violated
- Applicable law has been violated
- Another person’s rights may have been infringed
- Fraud or abuse has occurred
- The Content creates a security or safety risk
- Removal is required by a valid legal request
Deletion of Content may not immediately remove temporary backups or records that must be retained for security, fraud prevention, legal, or operational purposes.
10. Intellectual Property
You retain ownership of the Content you upload to Memollo.
Memollo retains its rights in its own materials, including its:
- Name and branding
- Logos
- Original text and graphics
- Animations and visual elements
- Website design and interfaces
- Software and code
- Original features and other materials
These materials may be protected by copyright, trademark, and other intellectual property laws.
Using Memollo does not give you ownership of Memollo’s intellectual property.
Unless permitted by applicable law or authorized by us, you may not copy, reproduce, distribute, sell, commercially exploit, reverse engineer, or create unauthorized derivative works from protected Memollo materials.
11. Third-Party Services and Music
Memollo relies on third-party services to provide certain functionality. These may include payment processors, hosting providers, database and storage providers, analytics services, and music or media providers.
Third-party services may have their own terms and privacy policies.
Music, media, or other third-party content available through Memollo may become unavailable because of licensing restrictions, geographic limitations, technical changes, or decisions made by third-party providers.
Memollo does not guarantee that a particular song, music selection, or third-party service will remain available indefinitely.
12. Service Availability and Changes
We work to keep Memollo secure and available, but we cannot guarantee uninterrupted or error-free operation.
The Service may occasionally experience:
- Maintenance
- Updates
- Technical problems
- Hosting or infrastructure outages
- Third-party service interruptions
- Security incidents
- Circumstances outside our reasonable control
We may add, modify, replace, or discontinue features as Memollo develops.
Where reasonably possible, we will try to avoid changes that unnecessarily interfere with already-purchased Gifts.
13. Disclaimer and Limitation of Liability
Memollo provides a tool for creating and sharing personalized digital Gifts.
We cannot guarantee that a recipient will open, enjoy, respond to, or react to a Gift in any particular way.
To the maximum extent permitted by applicable law, Memollo is provided on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, Memollo will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use the Service.
Memollo is not responsible for loss resulting from:
- A Gift link being shared by you or a recipient
- An editing link or access credential being disclosed
- Content uploaded without appropriate permission
- Temporary Service interruptions
- Third-party service failures
- Content that you did not separately back up
- Incompatibility with a particular device or browser
Nothing in these Terms excludes or limits liability, warranties, consumer protections, or other rights that cannot legally be excluded or limited.
14. International Users
Memollo is operated from British Columbia, Canada, and may be available to users in the United States and other countries.
If you access or use Memollo from outside Canada, you are responsible for complying with applicable local laws.
Certain consumer protection, privacy, cancellation, refund, or other statutory rights may vary depending on where you live.
Nothing in these Terms is intended to waive or limit rights that cannot legally be waived or limited.
15. Governing Law and Disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
However, if mandatory consumer protection laws in your country, state, province, or other jurisdiction apply to you, nothing in these Terms is intended to deprive you of protections that cannot legally be waived.
If a dispute arises, we encourage you to contact us first at hello@memollo.com so that we can attempt to resolve the issue directly.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes to Memollo, our technology, business practices, or applicable legal requirements.
When we make changes, we will update the “Last Updated” date at the top of this page.
Where appropriate, material changes may also be communicated through the Service.
Your continued use of Memollo after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
